Chandigarh: The Punjab State and Chandigarh Human Rights Commission has taken a strict view of alleged misuse of police powers and violation of Supreme Court guidelines, directing the Ludhiana Police Commissioner to conduct an inquiry and initiate action as per law.
The commission was hearing a complaint filed by Dr Sumeet Sofat, who alleged that the SHO of Police Station Division No. 8 and the in-charge of Police Post Ghumar Mandi issued an illegal and defective notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
According to the complaint, the notice was issued in connection with an FIR registered in October 2025 on the basis of a complaint by the Income Tax Department. However, it allegedly contained factual errors, including an incorrect FIR date and wrong residential details of family members.
Dr Sofat further contended that the sections invoked in the FIR were non-cognisable in nature. Despite this, the notice was issued in violation of legal provisions and contrary to Supreme Court rulings governing such procedures.
Taking note of the allegations, the commission has asked the Ludhiana Police Commissioner to examine the matter and ensure compliance with statutory provisions and judicial guidelines.
