Governor can’t stall bills indefinitely without taking action: Supreme Court

New Delhi: The Supreme Court has said that the Governor cannot hold the bills indefinitely without taking action. The court also said that as the unelected head of the state, the governor enjoys constitutional powers but he cannot use them to subvert the normal process of law-making by the state legislatures.

The bench said such an action would be contrary to the basic principles of constitutional democracy which is based on the parliamentary form of governance. The bench, in its November 10 order on a plea by the Punjab government, said if the Governor decides to stay the approval of a bill, he will have to send the bill back to the Vidhan Sabha for reconsideration.
