1984 anti-Sikh riots case: Delhi Lt Governor approves plea seeking acquittal of 12 accused in anti-Sikh riots case
New Delhi: Delhi Lieutenant Governor V K Saxena has approved the filing of an SLP in the Supreme Court against the Delhi High Court’s August 9, 2023 verdict acquitting 12 accused in the 1984 anti-Sikh riots case in the case titled “Raj vs Macaulay Ram and others”.
The FIR no. 501/1992 was registered at Nangloi police station under sections 147/148/149/302/201/323 of the IPC. Eight people were killed and one injured in Nangloi during the massacre. The 12 accused in the case are Macaulay Ram, Ramesh Chandra Sharma, Bishan Dutt Sharma, Des Raj Goyal, Anar Singh, Jagdish Prasad Sharma, Mahavir Singh, Balkishan, Dharampal, Om Pal Chauhan, Gyan Prakash and Ved Prakash.
The deceased have been identified as Avtar Singh, Jagir Singh, Darshan Singh, Kulwant Singh, Baldev Singh, Shravan Singh, Balwinder Singh and Harcharan Singh. A man named Dharminder Singh was injured. The Lt Governor has approved the proposal to file a Special Leave Petition (SLP) in the Supreme Court to challenge the august 9, 2023 decision of the High Court.
The high court said it did not give any explanation for the inordinate delay of 27 years in filing an appeal against the trial court’s April 29, 1995 verdict and the grounds raised by the state were not justified. Saxena, while perusing the file pertaining to the proposal to transfer the SLP, said the high court had not considered the merits of the case. Instead, the state’s appeal has been dismissed only on the ground of inordinate delay in filing the appeal.
