Allahabad High Court orders FIR against Rahul Gandhi in alleged dual citizenship case

New Delhi: The Lucknow bench of the Allahabad High Court has directed that an FIR be registered against Congress leader Rahul Gandhi in connection with an alleged dual citizenship case.

The court further ordered that the investigation be handed over to the Central Bureau of Investigation (CBI). The directive came while hearing a petition filed by a BJP worker, who alleged that Gandhi holds British citizenship, which would be illegal under Indian law.

Earlier, on January 28, 2026, an MP-MLA court had dismissed the petition citing lack of fresh or concrete evidence. However, the High Court has now taken a stricter view in the matter.

During the hearing, Justice Subhash Vidyarthi had asked the Union Home Ministry’s foreign division to present all relevant documents. The ministry reportedly submitted “top secret” files related to the case.

The petitioner claimed to possess evidence suggesting that Rahul Gandhi was registered as a voter in the United Kingdom and may have participated in elections there.

The plea has sought action under provisions of the Bharatiya Nyaya Sanhita (BNS), along with the Official Secrets Act, Passport Act and Foreigners Act. The court has termed the issue as serious and linked to national security.
