New Delhi: The Madhya Pradesh High Court has cancelled the anticipatory bail granted to former judge Giribala Singh in connection with the death case of Twisha Sharma. The court observed that the nature of allegations and facts of the case warranted cancellation of the relief earlier granted by a sessions court.
A sessions court had granted anticipatory bail to Giribala Singh on May 15. She, along with her son Samarth Singh, is facing allegations of dowry harassment. Samarth Singh is currently in CBI custody after the agency took over the investigation from the Madhya Pradesh Police.
Allowing petitions seeking cancellation of bail, Vacation Judge Justice Devnarayan Mishra, in a 17-page order issued on Wednesday, stated that “considering the facts of the case and allegations levelled against the respondent (Giribala Singh),” the anticipatory bail order passed by the Additional Sessions Judge stood cancelled.
Appearing for the CBI, Solicitor General Tushar Mehta argued that the manner in which anticipatory bail had been granted raised doubts over whether the trial court had properly considered all relevant aspects before passing the order.
