Chandigarh: Punjab cabinet minister Sanjeev Arora, who is currently in the custody of the Enforcement Directorate (ED) in a money laundering case, on Tuesday approached the Punjab and Haryana High Court seeking immediate release and calling his detention “unconstitutional”.
Arora was arrested on May 9 under the provisions of the Prevention of Money Laundering Act (PMLA).
Petition alleges violation of fundamental rights
In his petition, Arora claimed that his arrest was arbitrary and violated his fundamental rights guaranteed under Articles 14, 21 and 22 of the Constitution.
He has also sought quashing of the remand order issued by a special court in Gurugram, which had sent him to ED custody till May 16.
The matter has been listed before a division bench comprising Chief Justice Sheel Nagu and Justice Sanjeev Berry.
Senior advocate Puneet Bali is representing Arora before the court.
Arora says he resigned from company after assuming public office
The petition stated that Arora had been one of the promoters of Hampton Sky Realty Limited (HSRL), which had transparently started a mobile phone export business during the 2023-24 financial year.
Arora argued that after assuming public office, he resigned as chairman and managing director of the company and had no role in its day-to-day operations thereafter.
